GENERAL TERMS AND CONDITIONS FOR ONLINE TRADING - BIRKENSTOCK EUROPE GMBH (AS OF APRIL 2025)
I. CONTRACTING PARTNER, HOW A CONTRACT IS FORMED BETWEEN US AND YOUR CANCELLATION RIGHTS

Orders placed via our online shop for the United Kingdom (“UK”) the Website will only be delivered to customers in the UK.
2. How a Contract is Formed Between You and Us
The goods offered in the online shop do not represent any binding offer by us for the conclusion of a purchase contract. They merely represent an invitation by us to you to submit a binding offer. When you submit your order by clicking the "Order with fee" button, you submit a binding offer to conclude a purchase contract for the goods detailed in that order. After we receive your order, you will receive an email from us that confirms our receipt of that order (the "Confirmation email”). The contract between us will, however, only be formed when we send to you an email confirming the goods have been sent to you (the “Dispatch email”).
If we are unable to accept your order – for example if the product is out of stock or because of an error in the pricing and/or description of the product - we will inform you of this and not charge you for the product.
Once you have found the product you are looking for, you can place it into the shopping cart by clicking the "Add to Shopping Cart" button without any obligation. You can always view the content of the shopping cart without any obligation to purchase by clicking the shopping cart icon. You can always change the number of products or remove them from the shopping cart by clicking on the relevant buttons in the shopping cart. To purchase the products in the shopping cart, click the "Go to Checkout" button. You will be asked to enter your personal data, select a payment method and acknowledge the customer information. You can complete the order process by clicking the "Order with fee" button (or cancel your order by not clicking on this button or otherwise deleting all items from the shopping cart). You can correct and/or modify your details in the order process whenever you wish.
You will be notified of the acceptance of your order and of the dispatch of the goods ordered by email as soon as we hand the goods over to the carrier (‘contract and dispatch confirmation’).
If payment is made by credit card, your offer will be accepted by us upon the debiting of the credit card account specified or, if sooner, upon the goods ordered being dispatched.
If payment is made via PayPal, PayPal Express, Apple Pay, instant transfer or Klarna ‘Pay in 30 days’, your offer will be accepted by us upon your initiating the payment to us.
If goods within a single order are shipped in more than one package, you may receive a separate contract and dispatch confirmation for each package. In this instance, a separate contract will be concluded by and between us regarding the goods listed in each contract and dispatch confirmation.
For technical reasons, we cannot accept any orders placed by fax, letter or email.
Please note that all shipments – including deliveries and returns – are subject to customs handling and delivery times may therefore vary significantly. Any delays caused due to customs handling by official agencies or entities are beyond our control.
3. Changing Your Mind: Your Cancellation Rights as a Consumer
3.1 Right of Return and Refund:
If you are a consumer, you have a legal right to cancel a contract as detailed in this section 3.
Notwithstanding the statutory right of withdrawal as stated below (14-day cooling-off period), we additionally voluntarily accept withdrawal within 30 days in the case of these consumers.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
We will bear the costs for the return of the items if you use our returns label.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Bespoke Products. This cancellation right does not apply for contracts for the supply of goods that are not ready-made and for whose production an individual selection or determination by the consumer is relevant, or for goods that are clearly tailored to the personal needs of the consumer, unless the parties agree otherwise.
Returns of Faulty/ Mis-described Products. If you have return products to us because they are faulty or mis-described, we will refund the price of the products in full, together with any delivery charges, and any reasonable costs you incur in returning the product to us.

3.2 Additional information on how a cancellation might be processed:
If you wish to exercise your right of withdrawal, you will need to use the returns process to generate a returns label online.
Your statutory right of withdrawal pursuant to 3.1 shall remain unaffected by the information and notes as per this section, 3.2.
4. Other information (correction, storage of the contract text, contract language)
The contract text will not be stored by us and cannot be accessed after the completion of the order process. However, you can print out your order data immediately after submitting the order. The contract is concluded in English. Before submitting your order, i.e. before clicking the "Order with fee" button, you will have the opportunity to review the order and correct any input errors. Please carefully review your order.
II. ADDITIONAL CONTRACT TERMS
The following terms and conditions additionally apply to all orders placed via the Website.
1. Prices / availability / delivery restrictions
Our prices include the statutory VAT applicable at the time of order placement. Unless explained otherwise, we charge a fixed shipping fee. The latest conditions regarding shipping costs and any applicable free delivery thresholds will be made known during the ordering process.
Please note that in certain cases, we can only offer special offers for a limited period. Moreover, all offers are subject to availability. The availability of a product depends on the customer's requirements (size, colour, etc.) and is indicated for the respective product.
2. Payment terms
2.1 Accepted payment methods / general provisions
The goods may be paid for by means of one of the following payment methods

• Gift Certificate
Klarna's Pay in 3 / Pay in 30 days are unregulated credit agreements. Borrowing more than you can afford or paying late may negatively impact your financial status and ability to obtain credit. 18+, UK residents only. Subject to status. Ts&Cs and late fees apply.
Regardless of the selected payment method, you will receive an invoice by email.
2.2 Gift Certificates
Gift certificates and their balance can only be redeemed before the completion of the order process. A subsequent set-off is not possible. The balance of a gift certificate is not paid out in cash and does not bear interest.
3. Delivery terms
Delivery date: If the order is accepted, we will deliver the items you ordered within 3 to 5 business days.
The delivery is made to the delivery address indicated by the customer. The address must be in the UK. You will be informed of the dispatch via email. The goods will be delivered by a parcel service. The risk of accidental loss of the ordered goods passes to the customer as soon as the goods are handed over to the customer (Sec. 446 sent. 1 BGB) or if the customer is in default of acceptance (Sec. 300 para. 2 BGB).
We may make partial shipments insofar as you can reasonably be expected to accept such. Should partial shipments be made, we will bear any additional shipping costs.
4. Acceptance of the goods
To deliver your order, we will use a carrier of our choice. In the event of delivery of damaged goods, please report the damage goods immediately to the carrier employee and document the degree and scope of the damage. This does not limit your warranty or legal rights.
You may refuse acceptance of damaged goods or may return the goods to us. Please use the attached returns form for returns or in the event of withdrawal from a contract. Please contact our Customer Service department if you have any questions or initiate a return via our website using the necessary documentation.
5. Reservation of Title
We retain the title to any and all goods delivered by us until the receipt of payment in full. To assert our retention of title, we are entitled to demand the surrender of goods subject to retention of title under exclusion of all rights of retention.
6. Liability
If the goods are damaged or have any other defect (e.g. incomplete delivery), you are entitled to exercise the statutory warranty rights vis-à-vis us.
7. Interest on unpaid fees
If you are in arrears with payment, we reserve the right to charge statutory interest.
8. Miscellaneous
Which laws apply to this contract and where you may bring legal proceedings. These terms and conditions are governed by the law of the Federal Republic of Germany, under exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies only insofar as the protection provided is not withdrawn by compulsory provisions of the law of the country in which the consumer habitually resides.
8. Shipping Cossts
The prices quoted on the product pages of the Website contain the statutory value-added tax and other price components. In addition to the prices quoted, we charge £ 5.95 per order for the delivery within the UK.

III. Gift certificates and gift certificate redemption

Gift certificates are vouchers which you can purchase in the Birkenstock online shop (www.birkenstock.com/gb). Gift certificates are sent by email to the email address specified. They may only be used for items in the Birkenstock online shop (www.birkenstock.com/gb), but may not be used to buy other gift certificates. When a gift certificate is redeemed in the Birkenstock online shop, an automatic check is performed to determine whether the gift certificate is registered as valid in the system, i.e. has not been revoked or has not already been redeemed. Partial redemption of a gift certificate is possible (see 1.2 on (remaining) balance). If the balance of a gift certificate is not sufficient for a purchase, the remaining balance can be settled by means of the payment methods offered. Gift certificates may not be redeemed in Birkenstock stores or with Birkenstock retailers.

It is possible to redeem more than one gift certificate for a purchase.2. Refund
If you used a gift certificate for your purchase and returned the products, you will receive a new gift certificate for the amount for which you redeemed the certificate in the amount of the value of the returned goods.
3. Validity
The gift certificate and its balance can be redeemed until the end of the third year after the year in which the certificate was bought.
4. Transferability
The gift certificate is transferable. The seller can perform with discharging effect to the respective owner.
5. Loss
In case of loss or theft of your gift certificate, please contact our customer service at customerservice.gb@birkenstock.com. The customer service will then block the gift certificate. If the balance of the gift certificate has not yet been used, you will be reimbursed for the balance in the form of a new gift certificate. In this case, the old gift certificate will no longer be valid.
